TRAC Terms of Usage

TRAC Reports, Inc. hereby grants to the Authorized User, a non-exclusive and non-transferable license to access the TRACFED database subject to the terms and conditions outlined below and contingent upon Authorized User's payment of the subscription fee.

Authorized Users may search, view, retrieve and display single, printed, or electronic copies of single tables, graphs, or text pages of the TRACFED database. Authorized Users may also electronically save individual tables, graphs or text pages of the Licensed Materials for personal use. This license does not permit Authorized Users to download data for the purpose of creating a new database or using the data in an existing database.

Authorized Users may reproduce a single table or graph in preparing news and academic articles or academic publications, provided that Licensee expressly and prominently attributes the Transactional Records Access Clearinghouse as the source of the information in such articles and publications along with TRAC's full web address.

Under this agreement, Authorized Users of the TRACFED database are not permitted to use all or any part of the Licensed Materials for any Commercial Use, other than as articulated in this agreement. Under this agreement, Authorized Users of the TRACFED database are not permitted to use, copy, distribute or make available the Licensed Materials, works based on the Licensed Materials or works which combine them with any other material other than as expressly permitted in this agreement. Under this agreement, Authorized Users of the TRACFED database are not permitted to alter, abridge, adapt or modify the Licensed Materials, except to the extent necessary to make them perceptible on a computer screen. For the avoidance of doubt, no alteration of the words or their order is permitted.

Except as expressly provided in this agreement, TRAC Reports, Inc. makes no representations or warranties of any kind, express or implied, including, but not limited to, warranties of design, accuracy of the information contained in the TRACFED database, merchantability or fitness of use for a particular purpose. The TRACFED database is supplied 'as is'.

Under no circumstances shall TRAC Reports, Inc. be liable to Authorized Users or any other person, including but not limited to Authorized Users, for any special, exemplary, incidental or consequential damages of any character arising out of the inability to use, or the use of, the TRACFED database.

The Authorized User hereby acknowledges TRAC Reports, Inc.'s intellectual property rights in the TRACFED database, and further acknowledges that the business of TRAC Reports, Inc. is entirely dependent upon its rights held within the TRACFED database, and that any breach thereof constitutes a material breach of this agreement, in which event, this agreement shall immediately terminate; TRAC Reports, Inc. shall be entitled to immediate injunctive relief and to withdraw access to all of the TRACFED database without any rebate of the fees and without prejudice to any other rights or remedies to which it may be entitled.

Prohibited Data Harvesting, Automated Access, and AI Use

TRAC provides access to its information, publications, data, and interactive services for individual research, educational, journalistic, scholarly, and other authorized uses. Except with TRAC’s prior written permission, users may not systematically acquire, reproduce, extract, collect, copy, or reuse TRAC content or data in a manner that substitutes for, reconstructs, or materially replicates TRAC’s databases, services, or research products.

Without prior written authorization from TRAC, users may not:

Ordinary use of TRAC information by individuals—including reading TRAC publications, linking to TRAC pages, citing TRAC research, discussing TRAC findings, and using limited portions of TRAC information for scholarship, teaching, journalism, commentary, criticism, or other lawful purposes—is not prohibited by this section, provided that such use does not involve systematic extraction, bulk acquisition, database reconstruction, or incorporation of TRAC content into an artificial-intelligence or machine-learning system.

Use of TRAC information by an AI-assisted tool solely at the direction of an individual user for limited analysis, summarization, or editing of content lawfully obtained by that user does not by itself constitute prohibited AI training or ingestion, provided that the content is not retained for model training, incorporated into a persistent AI knowledge base, used to construct or supplement a dataset, or made available to other users as a substitute for TRAC.

TRAC may impose technical restrictions, rate limits, authentication requirements, licensing requirements, or other conditions on automated or high-volume access. The absence of a technical restriction does not constitute permission to engage in conduct prohibited by these Terms.

Requests for permission to conduct automated research, computational analysis, text or data mining, large-scale academic research, or other uses that would otherwise fall within these restrictions may be submitted to TRAC for consideration. Any such permission must be expressly granted in writing and may be subject to additional conditions, attribution requirements, access limits, licensing terms, or fees.

Any attempted or actual circumvention of these restrictions, systematic harvesting of TRAC resources, unauthorized construction of a substitute database or service, or unauthorized use of TRAC content or data for artificial-intelligence or machine-learning purposes constitutes a violation of these Terms and may result in suspension or termination of access and other remedies available to TRAC.
