One of President Donald Trump’s day one actions was rescinding former President Joe Biden’s executive order that had prioritized the detention and deportation of immigrants who posed a public safety risk, and deprioritized others. Since then, the number of immigrants in detention has doubled, according to the Transactional Records Access Clearinghouse. Those detained include asylum seekers and others with legal status, and the majority have no violent criminal records. Meanwhile, the Trump administration has also changed policy to allow fewer people the ability to leave detention while their cases proceed, presenting due process challenges.
