Criminal prosecutions for immigration offenses have played major role in the U.S. federal case schedule, especially in the 21st century. According to the Transactional Records Access Clearinghouse (TRAC),immigration offenses under §§ 1325 and 1326 have, at times, comprised a majority of all federal criminal prosecutions, surpassing drug trafficking and fraud cases during peak periods (TRAC, 2025).Recent statistics show enforcement at historically high levels:
i. § 1325 prosecutions nearly doubled in March 2025 compared with the previous month amidst intensified enforcement priorities (TRAC, 2025).....citing TRAC data and reports.
